John Fisher is an experienced health care attorney who has practiced extensively in the health care industry providing counsel to a wide variety of health care providers. John has counseled home health, hospice, personal care, and other post acute care providers on licensure, certification, health care regulatory compliance, contracts, mergers and acquisitions, joint ventures, recruitment and compensation issues, integrated network development, and Medicare and Medicaid reimbursementJohn is knowledgeable on the laws and regulations that affect financial relationships between health care providers including the Stark Law, Anti-kickback Statute and safe harbor regulations, fraud and abuse, antitrust and exempt organization tax issues. John has committed his career to remaining current on the ever changing regulations that impact health care providers.   He has been a frequent author and speaker on health law regulatory issues.   John is also an active blogger on legal issues that affect health care providers.

John holds Certification in Healthcare Compliance (CHC) with the Health Care Compliance Association and joins only a handful of attorneys in the state of Wisconsin to receive this distinction.  John is also Certified in Corporate Compliance and Ethics (CCEP) with the Society for Corporate Compliance and Ethics. John’s experience includes:

  • Represented a variety of post acute providers including nursing homes, home health agencies, personal care agencies, rehabilitation agencies, hospices, and others in a variety of health law, corporate, transnational, compliance and operational issues.
  • Formation and Certification of Medicare Certified Home Health Agencies.
  • Assisted providers in addressing survey deficiencies and establishing plan of corrections.
  • Advised home health, hospice and other providers on fraud and abuse, billing, medical information, and other compliance issues.
  • Developed compliance programs for a variety of health care providers including home health, hospice and personal care agencies.
  • Advised clients on an ongoing and transnational basis on health care fraud and abuse, Anti-kickback Statute and safe harbor regulations, all iterations of the Stark Law, and other regulatory requirements that affect operations and transactions.
  • Handled mergers, acquisition, and financing transactions including all transnational elements and compliance due diligence.
  • Assisted providers with change of ownership issues.
  • Defense of post acute care providers on overpayment requests from state and Federal government.
  • Structuring of corporate structures for multi entity healthcare systems.
  • Developed and performed effectiveness reviews of compliance programs for a variety of different types and sizes of health care providers.
  • Negotiation of electronic health information systems and various related software products and service.
  • Structured and formed various integrated delivery systems including multi-specialty and single-specialty independent practice associations, large and small physician group practices, and physician/hospital organizations.
  • Involved in numerous health care business transactions including joint ventures, mergers and acquisitions.
  • Prepared and negotiated a wide variety of contracts in the health care industry.
  • Advised clients on Medicare Reimbursement, compliance programs and other regulatory matters that impact their businesses.
